Two Domains same names one good one bad, one is mine the other is not. How do I get rid of the bad one?

My name is Jerry F. I own the domain www.jearbear.com But somebody has this same domain only they are using capitol letters in some of the letters such as Www.Jearbear.com So, they were able to create another domain. The problem is my Website sells Boyd bears, this other Website sells sex. How can I get Www.Jearbear.com removed without effecting my own domain?

would never happen, domain names are not case sensative, pages can be, but the bit before the .com or .net isnt ie

www.myaddy.com/index.html is the same as WWW.MYADDY.COM/index.html but not www.myaddy.com/INDEX.HTML
